Delaware County Family Court Office

Family Court Records Access in Delaware County

Family court records are not the same as other court files. In New York, FCA § 166 says these records are kept private to protect families and children. You can't just walk in and ask to see someone else's case. The law limits who can look at these files. Parties to the case, their lawyers, and some state agencies can get access. Others may need a court order.

Under 22 NYCRR § 205.5, the rules spell out how family court records should be handled. The court must keep case files safe and only share them with people who have a right to see them. If you are a party in a case, you can ask the clerk for copies. There may be a small fee for copies, but there is no filing fee to start a case in Family Court. That is a big deal for people who can't pay.

The Delaware County Family Court is part of the 6th Judicial District. This district also includes Broome, Chemung, Chenango, Cortland, Madison, Otsego, Schuyler, Tioga, and Tompkins counties.
